In order to apply for a work permit for the head of the representative office, manager, foreign worker must satisfy the following conditions:

✔ Work experience of more than 3 years relevant and related to work at the enterprise

✔ Degrees and certificates from university level.

✔Have full capacity for civil acts as prescribed by law (not serving criminal sentences at the time of receiving the license application)

✔Have health of grade III or higher and be objectively assessed by hospitals designated for medical examination for foreign workers.

✔Not guilty of criminal prosecution in Vietnam or in other countries.

Steps to apply for a work permit for the head of the representative office, manager.

Step 01:  Register foreign recruitment needs

The dossier includes:

∎ Document 01/PLI if registering for the first time as a recruitment demand for the head of the representative office, manager or 02/PLI if the recruitment demand has been registered before.

∎ Notarized copy business license.

∎ Personal referral letter representing the business to submit the application

∎ Notarized ID card of the representative individual.

Step 2: Submit the application for a  work permit to the head of the representative office, manager.

After obtaining written approval from the competent authority on registration of employing foreign workers, the foreign worker shall prepare all the following documents and send them to the Ministry or the Department of Labor, War Invalids and Social Affairs of the workplace.

The dossier includes:

∎ Personal introduction letter representing Vietnamese enterprises to submit and receive work permits.

∎ Model No. 11/PLI

∎ Notarized copy passport

∎ Criminal record card No. 1

∎ University degrees, colleges, working certificates in economics, management, business administration, finance … be legalized consulate in Vietnam and have the certification seal of the Department of Foreign Affairs of Vietnam.

∎ Confirmation of work and management experience from 5 years.

∎ Health certificate of eligibility to work in Vietnam

∎ The letter is approved in step 01.

∎ 2 color photos, size 4x6cm, white background, straight eyes, bare head, no sunglasses, clear face taken within 6 months from the date of application.

Note: The application must be sent at least 15 days before the expected date of the employee working at the Vietnamese enterprise. Applications will be received and processed within a maximum of 5 working days.

Stage 3: Get a work permit
